Wisconsin laws covering sexual assault, commonly referred to as rape, are divided into four different degrees based on varying factors. Laws covering sexual assault of children are categorized into two degrees. The penalties include:

Life imprisonment - 1st degree sexual assault of a child under 13 causing injury

Up to 60 years imprisonment - 1st degree sexual assult of a child or adult

Up to 40 years imprisonment & fine up to $100,000 - 2nd degree sexual assult of a child or adult

Up to 12.5 years imprisonment & fine up to $25,000 - Failure to Act

Up to 10 years imprisonment & fine up to $25,000 - 3rd degree sexual assault of an adult

Up to 9 months imprisonment & find up to $10,000 - 4th degree sexual assault of an adult
